A motion was made by Michal to approve the December 2, 2010 minutes to including removing Scott and Anne from “others in attendance”. Seconded by Terri. Motion carried.

A motion was made by Terri to approve the financials report and carry over any excess funds to 2011 and close the seconded by Christine. Motion carried.

A motion was made by Christine to accept Option C with American Pool Service pending any feedback from the pool committee within the next few weeks, seconded by Michael. Motion carried

A motion was made by Christine to approve the racing line installation, seconded by Michael. Motion carried.

A motion was made by Terri to adjourn the meeting at 9:00 am, seconded by Michael. Motion carried.

A motion was made by Andrew to approve the October 22, 2010 minutes seconded by Terri. Motion carried.

A motion was made by Andrew to approve the November 9, 2010 minutes, seconded by Christine. Motion carried.

A motion was made by Andrew to approve the financials report, seconded by Terri. Motion carried.

A motion was made by Andrew to approve the request for 5414 Highcroft Drive, second by Michael. Motion carried.

A motion was made by Terri to appoint Jean Ross and Jon Mulder to the ARC Committee, seconded by Christine. Motion carried.

A motion was made by Christine to not grant an easement or sell the property to owner at 5016 Sears Farm and they need to work within their property line. Seconded by Terri. Motion carried with a vote of 3 to 1.

A motion was made by Michael to inform the owner that the Board voted on no further action regarding the drainage pending further specification as to why the Covenants, including notice that the right of way is not a easement. The TOC has been consulted and has no issue. Seconded by Terri. Motion carried.

The meeting was called to order at 8:05 am by Mal

Scott Flor from American Pool presented resurfacing the pool and it was tabled until the next meeting.

Anne Gomes discussed the possibility of remodeling the restrooms and wants more detailed and discussions in the minutes. The pool committee is concerned about the service of American Pool and they will be present a letter to send to the pool company.

A motion was made by Andrew to approve the September 17, 2010 minutes seconded by Terri. Motion carried.

A motion was made by Andy to approve the November 2010 financials with changes, seconded by Terri. Motion carried.

A motion was made by to approve the 2011 Landscaping Contract with Mutch Landscaping by Andrew, seconded by Andy. Motion carried.

There were 37 owners in attendance and 22 proxies, quorum was established.

The meeting was called to order at 6:37 PM by President Terri Melcher Nelson.

A motion was made by Andrew to approve the minutes of the November 11, 2008 annual meeting. Seconded by Andy. Motion carried.

Presidents Report: Terri Melcher Nelson

· The following repairs were made at the pool in 2008/2009

o The path next to the playground and pool parking lot has been completed. The Board is working with landscaping companies to enhance the area for 2010

o The pool house and the concrete inside the pool area was powerwashed.

o The wooden deck in the pool area was repaired and stained.

o The pool house had some minor repairs made and the trim & posts were painted.

o VGB compliant drain covers were installed at the pool in order to pass inspection.

· The lights at the entrance of the community were changed from gas to electric.

· The water fountains at the pool have been repaired.

· 3 no soliciting signs have been installed at the entrances

· Approved contracts with Mutch Landscaping & American Pool. American Pool will be installing a salt system for the 2010 pool season.

· Approved the 2010 budget and kept the assessment rate at $520.00.

Andrew Moriarty discussed the property being affected by the Turnpike Authority. The Board elected Andy Sentgeorge to represent the Board of Directors and several owners that are being affected will work with the Town of Cary and Turnpike Authority. Kristin Lamendola volunteered to be the representative for the homeowners and will report to Andy.

Board of Director elections were held for two (2) open positions during the Highcroft annual meeting of homeowners on the evening of Tuesday, 9 November 2010.

Christine and Terri were elected. Christine will serve a 3-year term and Terri will serve a 2-year term.

A motion was made by Mal to approve the minutes as amended to include that James Dixon came to the meeting to present recommendations for improvement to the community. Seconded by Terri. Motion carried.

A motion was made by Terri to proceed with foreclosure on the home on Highcroft, seconded by Michael. Motion carried.

A motion was made by Andrew to approve the financials, seconded by Michael. Motion carried.

A motion was made by Terri to approve the ARC request for 1104 Tamworth Hill Lane, seconded by Andrew. Motion carried.

A motion was made by Andrew to approve the landscaping in front of the school. No second.

A motion was by Andrew to approve the landscaping proposal for Mutch weather permitting for $2580. Seconded by Mal. Motion carried with a vote of 3-0.

A motion was made by Terri to install two trees on the berm behind Laconia Woods, weather permitting not to exceed $500, seconded by Michael. Motion Carried.

A motion was made by Terri to approve the assessments for 2011 at $550 annually. Seconded by Michael. Motion carried.

A motion was made by Michael to approve the 2011 budget as discussed. Seconded by Mal. Motion carried.

Highcroft Village Pool usage

The HC Board has been asked to remind or inform the community that the Highcroft Village pool is only for the use Highcroft Village residents and their guests, just as our Highcroft pool is only for the use of Highcroft residents and their guests.

As we in Highcroft prefer our pool not be overrun with non-resident users/guests, please extend that same courtesy to Highcroft Village residents.

The practice of some HC residents using the HC Village pool has been tolerated by HC Village in the past, though it likely will not in the future.

2010 Highcroft Community Swim Season Pool Rules

POOL HOURS
· Open from dawn until dusk, except:
o 7:30 – 8:15 AM M,W,F for pool maintenance.
o 3 to 4 evenings per year for swim team meets.
POOL MEMBERSHIP
· The pool is for use of Highcroft Homeowners Association members and their guests. Please inform all guests and caregivers of pool rules and policies.
SAFETY & SECURITY
· No lifeguard on duty, swim at your own risk.
· Children must be under active supervision of a responsible adult.
· No one should swim alone.
· Please keep gate locked and do not prop it open.[1]
· No glass of any kind is permitted in the gated area.[2]
· No running or horseplay.
· Diving is not permitted as the pool is too shallow.[3]
· If thunder or lightning occurs, please exit the deck and pool immediately. Allow a minimum of 20 minutes from the last occurrence of thunder before re-entering the pool.
· For security reasons, a security camera has been placed to monitor unauthorized use of the pool. By using the pool, you consent to this monitoring.
· In case of emergency, call 911 – there is a phone next to the pool entrance as well as a first aid kit.
· No bikes, scooters, skateboards, roller skates, or other recreational wheeled vehicles are allowed inside the gated area.
MAINTENANCE
· Please stay off the lane lines as they are expensive to repair.
HYGIENE & SANITATION
· If you have diarrhea you are not permitted to swim. [3]
· Swim diapers AND plastic swim pants are required for all persons who are not toilet trained.
· Please change soiled diapers in the rest room only.
· Please do not enter pool if you have an infectious disease, open sore or wound, nasal or ear discharge, skin infection, inflamed eyes, or bandages.[3]
· Please shower before entering the pool. [3]
· Animals are not permitted in the gated area unless they are required to assist disabled individuals.
IN CASE OF FECAL INCIDENTS
Fecal matter in the pool poses a potential health risk. When contamination occurs, please follow these steps:
1. Instruct swimmers to exit the pool.
2. If possible, remove stool and dispose of in toilet.
3. Contact the pool management company at 878-3661 or 791-6292 and advise them whether:
a. The stool is easily picked up and illness is not suspected, or
b. The stool is loose, the stool is not easily picked up, or illness is suspected.
By informing the pool company of the nature of the incident, we can minimize the amount of time the pool needs to be closed.
4. Inform a member of the pool committee.

COURTESY
· Lap lane is for swimming laps.
· Food and drinks are not permitted in the pool.[3] Please enjoy picnics, snacks and drinks at the tables provided.
· Please properly dispose of trash, pick-up dropped food and wipe down tables after use.
· No smoking allowed at the pool or in restrooms.

The Highcroft Hurricanes Swim Team is looking for Junior Coaches for the 2009 swim season! Junior Coach is a salaried position which assists our head coaches with the younger swimmers on the team. The requirements are:

Must be between ages of 14-18
Must be a participant on the 2009 Hurricanes Swim Team
Preferably Life Guard Certified if of age (but not a requirement)
Youth Working Papers (by practice start)

Pool Hours

Open from dawn until dusk, except:

7:30 – 8:15 AM Monday, Wednesday and Friday for pool maintenance.
3 to 4 evenings per year for swim team meets.

Pool Membership

The pool is for use of Highcroft Homeowners Association members and their guests. Please inform all guests and caregivers of pool rules and policies.

Safety & Security

No lifeguard on duty, swim at your own risk.
Children must be under active supervision of a responsible adult.
No one should swim alone.
Please keep gate locked and do not prop it open.
No glass of any kind is permitted in the gated area.
No running or horseplay.
Diving is not permitted as the pool is too shallow.
If thunder or lightning occurs, please exit the deck and pool immediately. Allow a minimum of 20 minutes from the last occurrence of thunder before re-entering the pool.
For security reasons, a security camera has been placed to monitor unauthorized use of the pool. By using the pool, you consent to this monitoring.
In case of emergency, call 911 – there is a phone next to the pool entrance as well as a first aid kit.
No bikes, scooters, skateboards, roller skates, or other recreational wheeled vehicles are allowed inside the gated area.

Maintenance

Please stay off the lane lines as they are expensive to repair.

Hygiene & Sanitation

If you have diarrhea you are not permitted to swim.
Swim diapers AND plastic swim pants are required for all persons who are not toilet trained.
Please change soiled diapers in the rest room only.
Please do not enter pool if you have an infectious disease, open sore or wound, nasal or ear discharge, skin infection, inflamed eyes, or bandages.
Please shower before entering the pool.
Animals are not permitted in the gated area unless they are required to assist disabled individuals.

In Case of Fecal Incidents

Fecal matter in the pool poses a potential health risk. When contamination occurs, please follow these steps:

Instruct swimmers to exit the pool.
If possible, remove stool and dispose of in toilet.
Contact the pool management company at 795-8210 or 337-3135 and advise them whether:
1. The stool is easily picked up and illness is not suspected, or
2. The stool is loose, the stool is not easily picked up, or illness is suspected.
3. By informing the pool company of the nature of the incident, we can minimize the amount of time the pool needs to be closed.
Inform a member of the pool committee.

Board of Directors Meeting — August 2008

The meeting was called to order at 9:00 AM. In attendance were:

Property Management and Guests: Sue Fallwell (Omega Property Management), Sarah Heerman, and Heidi Stevens.

Sarah and Heidi participated in the discussion of the Millsfield pond and expressed their opinions on landscaping and types of fountains which could be installed. The minutes of the June meeting were approved as submitted (4-0). The financial report was discussed and Sue informed the Board the the HOA was reimbursed for the duplicate printing fee. The Board decided to put foreclosure proceedings on hold with liens being in place on properties delinquent in their assessments.

The Architectural Review Committee (ARC) report was reviewed and the Board approved the Collins ARC request (4-0). The Board also approved a yard of the month program with a budget of up to $300/year to be administered by the ARC. The Board requested the ARC provide the status on the Architectural Guidelines and to update the rules on fence tie ins requiring homeowners to consent to future hook ups as part of installing a fence. The Board voted to send a letter to the Patels about their encroachment onto the Wade/Buchannan property in violation of their ARC application.

The Board asked Sue to inspect the pool area for maintenance requirements and to report back at the next Board meeting. The Board approved the swim team request to add some outlets provided they are on a new circuit breaker. The Board appointed Paul to be liaison to the Pool Committee to finalize the decision on repairing and buying more pool furniture. The Board increased the monies allocated for this up to $6,000 (4-0).

The Board allocated $9,00 for the Millsfield Pond project and appointed Terry to serve as liaison. Any money over what is already in the budget for pond maintenance would be pulled from reserves (4-0).

The next Board meeting will be held on September 26 and the Board planned a site walk to inspect some landscaping issues. The meeting was adjourned at 10:55 AM.

Board of Directors Meeting — June 2008

The meeting was called to order at 9:15 AM. In attendance were:

The minutes of the May 16th meeting were approved as submitted (4-0).

The financial report was discussed. Sue informed the Board that the Progress Energy charges with the reference of 101 Abbeydale Ct, asked about in May, were mistakenly assessed to Highcroft. The charge was removed from Highcroft costs. The Board asked Sue to verify the two HOA printing charges for exactly $25.10 each, are accurate, and verify attorney fees for late assessments were passed to the homeowners. The financial report was approved (4-0) with Sue to verify above two items.

The board reviewed the recommendations from the ARC and made the following determinations:

1111 Tamworth Hill Lane – approved (5-0) with ARC recommended notes.
323 Millsfield Drive – Approved (5-0) with ARC recommended notes.
5406 Highcroft Drive – Approved (5-0) with ARC recommended notes.

The Board appointed Andy Sentgeorge the liaison to the ARC. Andy to discuss with the ARC about the adding estimated timeline (including start and finish dates) to the ARC Homeowner request form. Asked that the ARC be informed of general infracture notices sent to homeowners.

The Board asked for the Swim Team to be notified about the exposed ground wire in the concrete from the addition of the starting blocks. The Swim Team is to remedy the exposed wire by sealing from water intrusion. Asked the Pool Committee to work with Chase Pool Management to gradually replace the existing chaise loungers with a chair of higher quality. The Board approved (5-0) to allocate $3500 from reserves to purchase new chaise lounge chairs.

The Board discussed the issues of the path between Candia Lane and the swimming pool. Andy Sentgeorge and Andrew Moriarty will look into possible options as well as help with securing the proper engineering resources.

The Board approved (4-0) $650 for additional playground mulch.

The Board asked for quotes for a trumpet style fountain for the Millsfield pond. Tamworth Hill pond has some erosion at one end. Will monitor the situation and address when/if needed.

The Board reviewed correspondence sent to the association.

Andrew Moriarty signed abandonment plot submitted by the Town of Cary.

Board members to return with thoughts on the 5-year plan.

The next meeting was set for 15 August 2008 at 9:00am.

A motion carried (4-0) to write off the remaining assessment balance on this property to bad debt. The financial report was approved (4-0) with Sue to verify the Progress Energy charges with the reference of 101 Abbeydale Ct, which is not a Highcroft Community address.

The board reviewed the recommendations from the ARC and made the following determinations:

806 Landuff – approved (4-0) contingent on meeting all Town of Cary codes and all aspects of shed matching the current home; hardi-plank siding shall match the color of the home, trim shall match the trim color of the home, shingles shall match the shingles on the home, all doors and windows shall be consistent with home; and the shed shall be positioned up against the home.
515 Millsfield Drive – Approved (4-0) with the addition of the evergreens.
1129 Tamworth Hill Lane – Approved (4-0) with ARC recommended notes.
430 Chandler Grant – Approved (4-0) contingent on siding on screen porch to be of the same material and painted the same color as that of the house. Please advise neighbors of the project and obtain signatures in the future. Any required permits are the responsibility of the homeowner.
605 Laconia Woods Place – Approved (4-0) with ARC recommended notes.
5718 Highcroft Drive – Approved (4-0)

The Board asked to attend the next ARC scheduled meeting to discuss revisions to the ARC guidelines and the ARC review process. The next ARC meeting is 9 June 2008 from 7pm – 8 pm at Connelly’s Irish Pub.

The Board reviewed the pool committee notes. The Board approved (4-0) the use of 4 lanes for swim team practice and a practice swim team meet, with exclusive use of the pool, on Saturday 7 June with a revised time of 8am – 10:30am. It is requested that the team not use any loudspeaker system or bullhorn until after 9am.

The Board approved (4-0) Wakefield’s bid for plantings around the Candia pond.

The Board reviewed correspondence sent to the association.

The Board requested quotes for a concrete/boardwalk path from Candia to the swimming pool sidewalk, fountain for the Millsfield pond and mulch in the playground.

New Highcroft Newsletter

Update from the Pool Committee

Our neighborhood pool is one of Highcroft’s greatest assets. During last summer, pool closures (mostly due to fecal incidents) caused concern and inconvenience, as well as unnecessary expense. We recognize that our neighbors’ health and well-being is everyone’s top priority, and we all share in the responsibility. Toward that end, the HOA Board has designated a Pool Committee to facilitate discussion and recommend improvements to the board regarding communication, safety, and the comfort of the pool’s users.

Pool Guidelines

In keeping with the spirit of proactive and participatory operations, the Committee has developed a set of rules for the pool, which have been approved by the HOA Board and are effective for 2008. Also, we would like you to look at this CDC pamphlet on fecal incidents, namely their potential health hazards and how to prevent and respond to them. Please read these and educate your families.

Since our pool is not attended by a lifeguard or other staff, we ask that neighbors politely encourage all users of the pool to adhere to these guidelines. We further ask for respectful cooperation if a neighbor voices concern to you. Please remember that we are all responsible for health and safety at the pool.

New at the Pool

Residents will notice a few new things at the pool this year. We’ve installed a bulletin board to provide an official information resource at the pool. In the next few weeks we will install diaper changing stations in each bathroom and a new pool access gate, which will only require your key to enter (not exit). We will also be installing motion sensing lights and surveillance cameras to help prevent unauthorized use of the pool facilities. Finally we are installing a pH controller that will automatically balance the pool’s acid level. This will minimize pool down time due to the need for manual adjustment of chemicals.

Residents are free to use the pool for swimming lessons with a few restrictions. We ask that group lessons be held in the AM hours during swim team season (see below) and have 5 or fewer students. Private lessons can be held anytime the pool is not in use by the swim team.

Swim Team Schedule

The Highcroft Board of Directors has been working with the Highcroft Hurricanes swim team to develop a practice and meet schedule for the new swim season. As usual, we have had to balance the needs of the team, comprised entirely of our Highcroft neighbors, with the needs of the larger Highcroft community.

The team will use the pool for practice Mon, Tues (until June 10^th), Wed and Fri evenings from 4 until 7. Also practice will be held on Saturday mornings from 8 until 10:30. During practices the team will not have exclusive access to the pool and the community is free to swim at those times. Swim team practice will begin on May 19^th and end on July 22^nd.

Home meets for the swim team will be held on June 17^th, July 1^st, and July 22^nd and the swim team will require exclusive use of the pool on those evenings. Rain dates for those meets will be either the successive Wednesday or Thursday evening.

Finally

If you have a key from last season, it will work again this year. Additional keys to the pool can be obtained from Omega Management by calling 461-0102. There is a replacement fee of $20 for lost or duplicate keys.

Highcroft 5K/1K Fun Run — Saturday, May 3

The Highcroft Hurricanes swim team is once again putting together its 3rd Annual 5K/1K Fun Run fund raiser to support the Hurricanes swim team. We need your help to ensure it is a safe, fun and successful event. Here are some of the things we are asking for your help on.

Volunteers

We need two (2) people on Thursday, May 1st from 5 - 8PM (this will be to help with race packet pickup night)

We need sixteen (16) people on Saturday, May 3rd (this will be to help with registration and finish line support, timing and chip gathering) starting at 7:00 AM. 10 people for the race registration at 7:00AM and 6 for finish line support, at 8:15AM. So if you are not an early riser, we can still use your support.

Finish Runner - We need a person to run "clean up" as the final runner to make sure we close the course (my vote is for Jamie in the Banana suit).

Tables and Chairs:

We need seven (7) large (6') tables - 2 for packet pickup night (May 1st) and all of them on race day (May 3rd)

We need 10 chairs

If you can not help out in any of the above asks, we certainly encourage all the folks to help out the swim team by participating in the race. This event is the key fund raiser for the swim team. It will be a great event, with new categories this year for Clydesdale / Athena and a Baby stroller division for Moms or Dads with little ones. With your registration you will get race day snacks and water on the course, a great new T-shirt to commemorate the day and a chance to win a killer trophy for your wall of fame. Highcroft Spring Fling — Saturday, April 19

The Highcroft Spring Fling has been scheduled for April 19th from 2-4 PM at the pool parking lot. There will be mini clay pots to decorate, seeds to plant, and cookies to decorate and eat. There will also be an art and crafts station with wooden cut outs of snakes, flowers, turtles, and more to color and turn into magnets. For the finale...piñatas! Registration for the Highcroft Hurricanes Swim Team is coming up this month. Here are the details:

Physical registration will be at the pool
Pay by check or cash only
Swimsuits will be available to try on and order
Separate checks will be needed for suits and merchandise
Coaches will be present for questions

If you cannot attend the registration event, secure on-line registration will be available. Family IDs will be sent to current swim team families which will allow access to the web site. We expect those to be available no later than April 6.

Please contact one of the Board members directly if you would like a family ID and have not been involved with the swim team before.

The meeting was called to order at 9:20am. In attendance were:

Property Management and Guests: Tara Brandon (Omega Property Management), Anne Gomes (Pool Committee), Kerry (Wakefield Landscape), and Travis (Wakefield Landscape).

Kerry and Travis of Wakefield Landscape discussed general maintenance of the community common grounds as well as some issues of erosion around the ponds. In addition the frequency of special projects such as putting out pine straw was discussed. Wakefield agreed to give more frequent updates to the community on issues they find and recommendations they have.

The minutes of the previous meeting were approved as submitted (4-0). The financial report submitted by Omega was reviewed and accepted (4-0).

Anne Gomes presented the pool committee proposed rules and letter to be sent to each homeowner. Discussion was held on the need to ask homeowners to return a signed acknowledgement of the rules and to having the pool committee contact information on the rules sheet. The board approved the rules and letter as proposed by the pool committee 3 – 1 (Palonsky voting no). The approved the installation an auto feeder for chemicals in the pool per the quotation from Chase (4 -0). The board approved the fence proposal from Fortress fencing and authorized work to begin (4-0). The board approved a proposal from Southeastern Pool Phone to install and maintain a phone at the pool as required by code (4-0). The board approved the first 3 items listed on the quotation from Reilly’s Handyman service totaling $1550, and did not accept the remaining 2 items on the quote dealing with the bathroom taps and showerheads (4-0). The board approved the swim teams request for use of the pool for meets and practices with the limitation of using three lanes for their practice instead of the four requested (4-0).

The board reviewed the recommendations from the ARC and made the following decisions:

1) 805 Landuff project approved with the added restriction that homeowner must remove, cut to ground level or grind down the stumps of the trees on the common area which were removed at the homeowners expense. (4-0)

2) 903 Strathorn project approved (4-0)

The Board approved the Viagas / Romick architectural request, with the exclusion of the mailbox trellis feature by a vote of 3 – 0.

The board provided Tara with some guidance on how to monitor the appearance of the neighborhood. The board instructed that trashcans should be kept adjacent to the house. The board asked Tara to send out letters to any homeowner who has a playset, visible from the street, in their yard which has not received architectural review consent. However the board noted that we do not expect Tara to go behind houses to seek out playsets, but should respond to any complaints from residents on such playsets.

The Board reviewed correspondence. The next board meeting was scheduled for April 18^th. The meeting was adjourned at 11:00am

Swim Team Safety Screenings — Mark your Calendars

The Highcroft Hurricanes Swim Team coaches will be conducting three safety screenings for all 6 & Under swimmers to ensure the safety of all kids who want to participate on the Highcroft Hurricanes Swim Team.

At each safety screening, the coaches will evaluate the kids to ensure that they can swim 1/2 length of the pool safely. If they can do this, they will be able to participate on the Swim Team. If they cannot complete the length, they can try again on the second and third dates.

The first two screenings will be at the new Triangle Aquatic Center prior to the beginning of the swim season. Our hope is that this will allow plenty of time for those children who still need to improve their swimming skills to do so before the swim season starts. The third safety screening will be on the first day of practice, which will be 19 May.

We know this is a new approach, so we'd like to explain our rationale: During each of our first three seasons, about 1/3 of the swim team was comprised of 6 & Under swimmers. It is great to have such terrific involvement by the youngest members of our community, as well as such strong parental support, but it also has presented challenges for our coaches as far as assuring safety for all swimmers. As always, our focus this swim season will be on fun, personal growth, and sportsmanship, but we expect the safety screenings to allow us to also make sure the pool is safe for everyone, especially our littlest swimmers.

The first date to remember is Sunday, 30 March 2008 from 2-3 PM at the Triangle Aquatics Center.The second date is Sunday, 27 April 2008 from 1-2 PM, followed by a pool party open to all swimmers (and their families) from 2-4 PM. Details about the pool party to be provided later.

Jamie Dixon reported on the activities of the swim team. The Annual Road Race fundraiser will be held on May 3^rd. Jamie also discussed his idea on the amount of time and space the swim team might need for their practices and meets. Jamie noted that some swim meets might be on Saturday mornings this year. The Board provided Jamie with some general feedback and Jamie plans to come back with a proposal for the Board to consider at the April meeting.

The Board welcomed Michelle Saleen as the new Social Committee Chairperson and had general discussions on the responsibilities and budget allocation for Highcroft socials.

The Board discussed the operation of the pool with Greg Cowen of Chase pool management. Included in the discussion were the benefits of installing a pool cover over the pool during the off season. Greg gave the Board in informal estimate of around $7,500 for the purchase and installation of a pool cover. If the Board wanted to go forward it would need to authorize the project in the June timeframe. The Board voted 4-0 in favor of operating the pool from May 17^th to September 28^th for the 2008 pool season.

Mal Shah left the meeting at 10 AM.

The Board further discussed with Greg the use of an auto feeder for chemicals in the pool and requested a quotation.

The Board approved the Viagas/Romick architectural request, with the exclusion of the mailbox trellis feature by a vote of 3-0.

The Board reviewed quotations from the recent RFQ on landscaping and requested that a representative of the current landscape company, Wakefield, attend the next meeting to discuss concerns the Board has with the current upkeep of the association property.

The next meeting was set for March 28 and the meeting adjourned at 10:55 AM.

Board of Directors Meeting Minutes — January 2008

Andrew Moriarty called the meeting to order at 9:10 AM. All board members were present. The minutes from the November 29, 2007 meeting were approved. THe board decided to reorganize the officer slate and the following new assignments were made and approved by a 5-0 vote:

Wilson Farrel made the pool committee report. One item requiring board action under new business at a future meeting is to discuss the pool rules for 2008. Wilson presented the swim team's request to install starting blocks at the swim team's expense. This would require a hole to be cut into the pool deck for each of the starting blocks. THe baord gave permission to allow this installation as long as the hole was covered by a metallic non-rusting cover. The motion granting permission was approved 5-0.

Sue Farwell gave the financial report. This report was approved after adding $1,200 for the additional dirt which was required for the berm project. It was noted that some residents reported water pooling by the berm and Omega was requested to review the situation.

Under new business, the contract with Foster for maintenance of the Lakes was approved by a 5-0 vote. Paul Palonsky brought up setting up a neighborhood watch and the board agreed to establish a neighborhood watch committee. During general discussion the request for a fence along Sears Farm Road, the anticipated requirements of the swim team and the need to update and revise the Architectural guidelines were discussed. The meeting was adjourned at 10:45 AM.

Western Wake Freeway

The North Carolina Turnpike Authority (NCTA) is providing this letter to update property owners within or adjacent to the Western Wake Freeway portion of the Triangle Expressway proyect.

Western Wake Freeway is a proposed 12.6 mile, six-lane, controlled access toll facility on new location from NC 55 at SR 1172 (Old Smithfield Road) to NC 55 near SR 1630 (Alston Avenue). A figure showing the project location is attached. More detailed maps of the project are available on our website (View Citizens lnformational Workshop Maps 1, 2, 3 and 4 of 4).

In 2007, the North Carolina House and Senate passed two separate bills that would have provided the NCTA the "gap funds" needed to construct the project. The Senate bill would have generated funding from an increase in passenger vehicle registration fees. The house bill would have appropriated funds from the General Fund. Unfortunately, the House and Senate did not reach a consensus on the funding source prior to adjourning from session: therefore, "gap funding" for the NCTA was not secured.

NCTA is currently pursuing several funding options, including continued efforts through the NC General Assembly and/or other potential private sources. The NCTA is optimistic that funding can be secured in 2008; however, funding is not guaranteed. Understanding the importance of this highway to the region, the NCTA proceeded with the advertisement of the Western Wake Freeway project on December 3, 2007. If funding is secured by spring 2008, construction contracts could be awarded in summer 2008.

The NCTA understands how difficult the uncertainty associated with funding and scbeduling is for you as a property owner. The NCTA is diligently working to move the Western Wake Freeway project forward.

The NCTA will continue to keep you up to date on the progress of funding and the purchase of right-of-way. Once funding is secured, the NCTA will contact all affected property owners regarding the right-of-way acquisition process nnd schedule.

The NCTA is trying to move the process along as quickly as possible and intend to keep you apprised of our progress along the way.

Communications Committee Meeting Minutes

Mission. We discussed the mission of the communications committee and agreed that our goal is to disseminate information to the community through suitable channels. Those channels will include this web site as well as a quarterly newsletter. We do not intend to be a conduit between the Board of Directors and the residents of Highcroft.

Web site. We outlined the content of the community web site. There is an open question regarding whether or not we can monitor the visits to the web site.

Newsletter. The "Highcroft Breeze" will be published quarterly starting February 2008. The content of the newsletter will be determined on an ongoing basis.

Task Delegation. Christine Qubeck and Robin Krizan will be responsible for creating the quarterly newsletter. Janine Lamb and Courtney Wine will be collecting board and committee information, mission statements, chairperson's and member's contact information and meeting minutes. Beth Gozon is responsible for getting the minutes from the annual and monthly board meetings and annual budget from Omega Association Management in electronic format. Jim Lamb is responisble for developing the web presence for the committee.

Next meeting. The next communications committee meeting is scheduled for December 8 at 2 PM.

Traffic Calming Update

Highcroft is a great community, in a great town. We're fortunate to have a school, a pool, a park and playground, and greenways all within walking distance. These amenities have helped create an exceptional and welcoming environment for our families.

As you may already know, a volunteer committee has been working for more than two years to ensure Highcroft roads are as safe as possible for its families. The following points summarize the drivers (no pun intended) behind the traffic calming effort...

Highcroft Drive and Sears Farm Road are the main roads of our community
Average daily traffic volume on Highcroft Drive is approximately 1,100 vehicles
Average daily traffic volume on Sears Farm Road is approximately 800 vehicles
Approximately 70% of vehicles exceed 25 mph and 30% exceed 30 mph
Future daily traffic volume on Highcroft Drive is expected to double or triple
68 families live along Highcroft Drive and 16 families live along Sears Farm Road
Children from all corners of the community walk, cycle, and play along these roads

The committee was recently successful in lobbying the town to lower the speed limit on Highcroft Drive from 35 mph to 25 mph. Unfortunately, studies have shown that a reduced speed limit is rarely effective without traffic calming. This finding is supported by the speeds recorded on Sears Farm Road, which is alos posted at 25 mph.

Furthermore, Highcroft Drive is a designated collector road that will be extended as part of a larger transportation network. With this connectivitiy, and continued growth in the area, the town expects the existing traffic volume to double or triple. This increase will be comprised of non-residents driving through Highcroft to reach destinations further north or south, and who are not consciously vested in the safety of our community. Traffic calming will deter this "cut-through" traffic.

In the coming weeks, a petition will begin circulating to seek your approval for implementation of traffic calming on Highcroft Drive and Sears Farm Road. Details of the proposed traffic calming plan, its funding, and additional information can be found at the link below.

Pool Committee Recommendations — Fall 2007

The Highcroft pool is the centerpiece of our community. It not only provides a valuable outlet for exercise and fun, but it is also our neighborhood’s social center. As the 2007 swim season wraps up, we should reflect on the lessons we learned this summer and start preparing for next summer. The pool opened on May 19th to the great excitement of its many users. The 120+ member swim team began preparing for their swim season in which they compiled a record of 3 and 2. We held a few neighborhood parties including a frog jumping contest and a National Night Out celebration. There has been plenty of great swim weather this year, and the pool offered a pleasant respite when temperatures soared.

Despite the positive aspects of this summer, we have also seen a number of days in which the pool could not be used. The cause of these outages ranged from mechanical failure (a pump failure) to mischief (a week long closure caused by intruders introducing broken glass into the pool) to accidents (at least 4 fecal contamination incidents). These incidents have caused monetary expenditures in excess of $6000 and over 2 weeks in days the pool has been unusable by the community.

In response to these incidents, a group of concerned residents formed the Highcroft Pool Committee (HPC). The committee had its initial meeting on August 5th, after which we sought formal recognition from the HOA board. We received that recognition on August 13th. One of our initial tasks was to draft a set of community rules that were to augment the county and state rules that are posted at the gate. This set of rules is attached to this report and we encourage the HOA board to approve these rules effective for the 2008 swim season. We have also discussed improvements to the pool and its management, and that is the purpose of this report.

Our Goals

The goal of the HPC is to assist the HOA board with matters regarding the pool. As we are not elected by the community, we have no authority to expend funds, enact rules or policy, or take action against those who violate pool rules and policy. Our primary purpose is to make recommendations to the board in those respects.

A common criticism of pool management to date has been the lack of effective communications. Residents feel there is no good outlet to voice their concerns and opinions. Further, the communication mechanisms that the HOA board and Omega use to contact the community are underutilized, cumbersome and inefficient. Improvement to communication is another goal of the HPC. The HPC will act as the primary communication conduit for pool related matters in both directions.

In order to effectively act in these capacities, the HPC must be included in pool related actions and decisions.

Proposed Rules

The proposed rules are presented in an attached document, along with a proposed cover letter that will accompany the rules. In making these rules, we consulted county and state regulations, we reviewed pool rules from other communities and we discussed the specific requirements of the Highcroft pool. We encourage the HOA Board to approve these rules and send them out with the soon-to-be-released annual meeting announcement.

Further we suggest that the approach to enforcement should be incremental based on need. At this time we do not recommend hiring attendants or lifeguards, rather pool users should be encouraged to self-police better. The establishment of these rules is essential to that approach. If this approach does not work, we will revisit the need for an attendant or even a lifeguard.

Recommendations

Recommendations are summarized in table 1.

Safety and Hygiene. One of our primary concerns is reducing the risk of disease through fecal contamination. You will see from our rules that the issue played heavily. Of primary importance is keeping individuals with the potential to infect out of the pool entirely. Of secondary importance is ensuring children who are not potty trained are protected against accident through the use of BOTH a swim diaper AND plastic swim pants.
- Recommendation #1 (High) - Signage at the pool to emphasize the importance of not swimming with diarrhea and ensuring children wear swim diapers and plastic pants.
- Recommendation #2 (High) - Diaper changing stations should be provided in both the men’s and women’s restrooms. Soiled diapers should not be changed on the deck as stated in the rules. Estimated cost: $170 - $250 each.
While having rules regarding proper hygiene is required, we believe that a “campaign” is necessary to promote understanding of the dangers of fecal contamination. Accompanying our rules will be information from the CDC regarding this issue.

Security. The need for additional security measures at the pool was emphasized this summer when a group of individuals entered the pool area after dark and threw glass bottles into the pool. This incident alone caused us to drain the pool, incurred significant cost and took the pool away for a week during the peak of summer activity. There have been several other minor incidents at the pool that involve late night activity. While it is generally recognized that individuals will find a way into the pool if they are sufficiently motivated, the Highcroft pool is not particularly hard to get enter and the motivation required is not that great. The current residential grade 4 foot fence is simple to scale and the gate is frequently unsecured because it does not shut properly. Additionally, it is believed that a number of non-residents/non-guests use the pool during the daylight hours. We do not know the scale of this particular problem, but we believe that this problem will only get worse if not addressed.

To our knowledge, the HOA board has already approved the following:
- A new gate
- Motion sensing lights
- A security camera that will be donated by Jeff King
If these improvements do not prove to be sufficient, we believe that further measures should be taken to prevent unauthorized access to the pool.
- Recommendation #3 (high to moderate/as required) - The existing fence should be replaced with a 6 foot commercial grade fence. The anticipated cost of this is ~$15,000; however the price can be lowered if we consider selling the old panels or even taking down the old fence ourselves. We are sure that we could get a number of volunteers from the neighborhood especially with the promise of a “barn-raising” style party to follow. This is recommended if current/planned measures do not sufficiently prevent unauthorized entry.
- Recommendation #4 (moderate/as required) - The new gate should be equipped with a card entry system. This will greatly increase our flexibility with respect to controlling access to the pool. Among other things, a card entry system can be programmed to close the pool at night, to exclude members for various reasons, and to better track use. It should also be noted that without implementing a higher perimeter fence, the effectiveness of a card entry system will be diminished. Estimated cost: ~ $4000 (plus $6 per card and $40 recurring monthly admin fee).

Communications. We feel that the HOA needs to address communications for the community as a whole. We want the community to contact to the pool committee rather than the HOA Board or Omega with feedback and issues regarding the pool. This provides a “one stop” means of communicating about the pool and will be less confusing to residents. The only exception to this is in the case of fecal incidents and other time-critical maintenance issues, when we recommend contacting the pool management company directly to expedite correction. We have published our contact information in the pool rules with the intent of collecting this information. Tracking and ensuring issues are properly handled will be the responsibility of the HPC.
- Recommendation #5 (High) - Direct all pool related issues to the pool committee. Bring the pool committee up to date on any pool related issues or agreements that existed prior to the formation of the committee.
The pool committee will often need to communicate with the community at large. We propose a number of mechanisms to assist in that communication.
- Recommendation #5 (High) - Direct all pool related issues to the pool committee. Bring the pool committee up to date on any pool related issues or agreements that existed prior to the formation of the committee.
The pool committee will often need to communicate with the community at large. We propose a number of mechanisms to assist in that communication.
1. A web presence. The pool committee should have a dedicated web page or pages for the purpose of making announcements and providing a clearinghouse for information. This page may be a dedicated web site, but we would prefer to be part of a larger Highcroft community web site. The web site should allow for the easy upload of information by the pool committee.
2. An Email list. We would like for residents to be able and encouraged to subscribe to an email list over which they can receive announcements and material when it is released. This would not be a discussion board, but would only allow community leadership to communicate with the community at large. The list would be maintained by residential address so the pool committee would know who should be contacted by an alternative means when critical announcements are made.
3. Better use of block captains. We feel that the block captain framework that is currently in place is underutilized. This can be used to contact residents who have not subscribed to the email list when important announcements are made.
4. A newsletter. The HPC should either produce a quarterly newsletter or contribute to a community newsletter. The newsletter would provide educational content and information about events, rules and policy.
5. A Bulletin Board at the pool. A bulletin board should be installed at the pool to serve as a central repository for announcements. The board should be covered with plexiglass and should be large enough to allow for announcements and signage for the pool committee, the swim team and the HOA at large.
- Recommendation #6 (High) - The HOA Board should form a communications committee that will build and update a website, produce a newsletter, maintain an email address list and make announcements on behalf of the Board and the Highcroft HOA committees, including the pool committee.
- Recommendation #7 (High) - The HOA Board should approve the purchase or construction of a bulletin board for installation at the pool. We already have a volunteer from the neighborhood who will construct one for the cost of material, estimated to be around $150.

Other Infrastructure Improvements and maintenance. The pool committee has discussed a number of infrastructure improvements over the past month:
1. Replacement of bathroom sink and shower fixtures with self closing faucets that will shut themselves off if they are left unattended. Estimated Cost: $500 + labor
2. Restrapping of chase lounges. Over the past few years most of the chase lounges we have been severely discolored. Dori, from Chase, explained that this is due to the use of sunless tanning products. The staining cannot be taken out and the chairs should be restrapped to address this issue. Estimated Cost: $1400
3. New umbrellas. A number of umbrellas are bent or do not function properly. They should be replaced with higher quality umbrellas. Estimated Cost: $600
4. Emergency pump shutoff button cover. The cutoff button is exposed and low enough for children to access it. A cover will reduce the risk of having the pump inadvertently shutoff. Estimated cost: $40
5. Wading/baby pool. Not only would a wading pool would be a great asset for our youngest residents, but according to Wake County Hygiene and Recreation officials would cut down on the number of fecal incidents in our existing pool. The estimated cost of this project would be around $24,000.
- Recommendation #8 (High) - Items a, b, c, and d should be approved and completed before the 2008 swim season begins.
- Recommendation #9 (Moderate) - A survey should be conducted to assess the interest in possible recreational improvements to the pool. Communicate results of survey to community.

Conclusion

The members of the pool committee are excited about the opportunity to have a positive impact on their community. Our goal is to make our pool into a safe and inviting place for Highcroft residents of all ages. We look forward to working with the board, Omega, and Chase to ready the pool for the summer of 2008.

Discussion of Rules

We talked about the new revised, written pool rules that will be sent to all homeowners sometime this year.

Pool to be open dusk to dawn (new sign for front of pool).

We want to put together a letter talking about pool safety and hygiene.

When the new revised pool rules come out we would like all homeowners along with the kids read the rules and all members of the family sign a copy and send in to HOA for new pool key.

When new homeowners move into community we would like the management company to send the pool rules and cover letter sent out requiring their signature before their key is released to them.

Cleaning

The pool will be closed for vacuuming M-W-F 7:30 to 8:00 a.m. by pool company. We would also like the pool company to keep record of all incidents at the pool and distribute to pool committee and HOA once a month.

All pool committee members would like to meet with pool company and go over their process for pool cleaning.

Security

How is the pool gate coming along - talked about instead of a key, possibly getting the cards with the reader. Debbie Newsom will check into price of card verses key.

Talked a little about security camera.

Suggestions

We discussed the possibility of a smaller pool for kids 2 years old and younger.

We would like the HOA to get bids on replacing all faucets in the bathrooms and shower to automatic shut off for water conservation.

Would like HOA to have the red brick in front of pool fixed ASAP. Several bricks have come loose from pillars in front of pool entrance.

Is this within our budget to install and maintain?

Attendees: Wilson Farrell, Anne Gomes, Beth Gozon, Janine Lamb, Mari Wade

This was the initial organizational meeting of the unofficial pool committee for the Highcroft Home Owner’s Association. This committee was formed in reaction to recent incidents at the pool that have caused its closure.

The meeting began with a discussion about the purpose of the committee. It was generally agreed that the committee would perform the pool related functions that the HOA board is currently charged with. This would include the development of pool rules and policy that would be submitted to the board for modification and approval. Further the pool committee would suggest infrastructure improvements to the pool facilities based on resident surveys and cost analyses. At a high level the pool committee’s goal would be:

Help prevent accidental closures

Handle incidents and communicate status of the pool to the residents

Promote safety

Maintain the pool as a community resource

The HOA board recently approved motion sensing lights and the installation of a video surveillance system (camera donated by Jeff King). Omega management is currently coordinating the installation of those items. The HOA board is next meeting in September and we should have any budget items developed by that time so that the board can consider those. As a result any recommendations created by this committee would not be acted upon until that meeting and would apply to the 2008 swim season.

The merits of life guards vs. attendants vs. self policing were discussed at length. It was agreed that the general approach would be incremental based on need. Initially the pool committee would work with the HOA and the HOA Board to develop policy and rules. The accepted policy and rules would be communicated to the community. This communication would take various forms (see below “Specific solutions”). The pool committee will then monitor how the community is able to police itself. It is the hope of the committee that general acceptance and knowledge of pool rules will be sufficient to minimize pool closure and infrastructure repair costs. If accidental pool closures or pool damage continue to occur the pool committee will revisit the need to hire an attendant or a life guard(s). This possibility would likely result in an increase in HOA dues and this should act as additional incentive for residents to try to make self-policing work.

We were unsure about what was required to approve policy and rules governing the use of the pool. Would board approval be sufficient or would HOA resident vote be required? We will consult the by-laws and request clarification from the HOA board as required.

We discussed how our committee will fit into the current set of roles and responsibilities between the HOA board, Omega Management and current pool maintenance company. We need to research what the HOA board currently does with regard to the pool and what Omega is charged with. Wilson will call Sue to discuss these issues and will research the roles of pool committees in other communities.

Further, we questioned our own charter. We are not currently an HOA board appointed committee. Nonetheless, we see ourselves as a group of concerned residents wish to assist the HOA board with issues surrounding the pool. We can only recommend improvements and policy to the board. It is up to the board to approve, deny or ignore our recommendations.

Specific solutions discussed. In the course of the meeting we diverged into possible solutions and approaches to mitigate pool closures. For posterity those are captured here.

Sign in sheet – Janine Lamb suggested that the pool could have a sign-in sheet for families who use the pool. On the sheet would be a checkbox to remind parents that a swim diaper and a plastic liner are required. While there would be minimal enforcement of the use of the sign-in, it may serve as a constant reminder to parents of young children to not forget these important items.

Signage – We all agreed that better signage is required at the pool to inform pool users of town, county and state regulations regarding use of the pool. Signage would also be required when HOA specific rules are agreed upon. Anne Gomes agreed to research town, county and state regulations.

Policy/rules letter – Wilson Farrell suggested that we should send out a policy/rule letter to all residents prior to this year’s annual meeting and prior to the beginning of each swim season. It was further suggested that pool users would have to sign an acceptance letter before the new swim season begins. It was pointed out that residents may balk at signature requirement as access to the pool is a right granted by the neighborhood covenant. While this can be researched, it was agreed that we should at least send pool rules and policy out to residents before every swim season. This policy/rule mailing should include the cost of incidents and the amount of pool down time from the previous season.

Gate – Access to the pool is controlled though a gate that requires a key to unlock. This gate has been damaged through use (and misuse) and not longer locks effectively. While we all agreed that the gate needed be addressed, there was discussion as to whether the current gate mechanism is sufficient if repaired or whether a more robust solution is needed, such as a cardkey system. We are unsure about the current status of this issue and we will follow up with Omega Management and the HOA board as required.

Emergency cut-off switch cover - We observed that the emergency cut-off switch for the pool pump is reachable by children. It was further noted that the pool has been shocked (and subsequently closed for 24 hours) two times this summer because the emergency cut-off has been inadvertently hit. We think at the very least we should provide a cover for the switch to help prevent recurrence of this. This should be a low cost item.

To do list - A few simple repair items were mentioned, such as the bricks on the front columns that need to be re-set. A to do list was suggested that residents could volunteer to address. A concern was raised that some of these items may be covered under contract or warrantee. Again, Omega Management will be consulted about this idea.
